According to Jay D. Wexler, a law professor at Boston University, our Supreme Court Justices are funnier than you might expect. By reviewing transcript notations featuring “laughter”, Professor Wexler’s study found Justice Scalia to be the Court Jester whereas Justice Thomas prompted no laughter at all. (I guess the laughs still on us ever since the Thomas Confirmation Hearings.) The New York Times most recently examined transcripts starting last fall and reports that, under Chief Justice Roberts, the number of “laughs per argument has increased to 2.9, up from 2.6 the previous term. However, from the sorry one liners I read in the transcripts, I doubt any of these sitting Justices will ever be confused with the Last Comic Standing.
